Terms & Conditions – K. Pauw Photography

Welcome to K. Pauw Photography! These Terms and Conditions govern the services provided by photographer Katinka Pauw. By booking a session, you agree to the following terms.

1. Booking & Payment

1.1. A non-refundable deposit of 25% is required to secure any booking. The remaining balance is due as follows:

Standard Sessions (Portrait, Boudoir, Maternity, etc.): Payment due on or before the day of the session.
Wedding Photography: Payment due no later than 14 days before the wedding.
1.2. If full payment is not received by the deadline, the Photographer reserves the right to cancel the booking, and the deposit will be forfeited.
1.3. Travel and accommodation fees apply for locations outside Curaçao and must be covered by the Client.

2. Cancellations & Rescheduling

2.1. Client Cancellations:

Deposits are non-refundable.
Weddings canceled within 14 days of the event require full payment.

2.2. Rescheduling Requests:

Must be made at least 14 days in advance and are subject to availability.
If rescheduling is not possible, the deposit is forfeited.

2.3. Photographer Cancellations:

If the Photographer must cancel due to unforeseen circumstances, an alternative date will be arranged, or a full refund will be issued.
For weddings, a trusted replacement photographer will be arranged if possible.

3. Photography Rights & Copyright

3.1. All images remain the copyright of K. Pauw Photography. The Client receives a personal-use license only.
3.2. Clients may not edit, alter, sell, or use images for commercial purposes without written consent.
3.3. K. Pauw Photography reserves the right to use images for portfolio, website, social media, and promotional purposes unless the Client submits a written request for privacy before the session.

4. Photography Coverage & Client Responsibilities

4.1. Standard Sessions: The Client is responsible for arriving on time. Delays may result in a shorter session or additional fees.
4.2. Wedding Photography:

The Photographer will make every effort to capture key moments but cannot guarantee every shot due to external factors (lighting, venue restrictions, guest interference, etc.).
The Client must inform the Photographer in advance of any special moments or important guests to prioritize in the coverage.
The Client agrees to limit guest photography during key moments (e.g., ceremony, first dance) to avoid interference.
The Client agrees that K. Pauw Photography is the exclusive professional photographer for the event.

5. Image Delivery & Editing

5.1. Delivery Timeline:

Standard sessions: Edited images will be delivered within 2 days.
Weddings: Edited images will be delivered within 1 week.

5.2. The Photographer has full creative control over the editing style.
5.3. Raw (unedited) images will not be provided.
5.4. Album design and print orders will be processed after Client approval and may require additional production time.

6. Force Majeure & Liability

6.1. The Photographer is not liable for factors beyond her control, such as:

Extreme weather conditions, venue restrictions, guest interference, or unexpected lighting issues.
Equipment failure or data loss (in such cases, a reshoot may be offered if possible).
Any injuries, accidents, or damages that occur during the session.

6.2. If an unforeseen event prevents the Photographer from delivering images (e.g., illness, natural disaster), liability is limited to a refund of amounts paid.

7. Privacy & Confidentiality

7.1. Client information will be handled with care and will not be shared with third parties without consent.
7.2. If the Client wishes to keep images private, a written request must be submitted before the session.

8. Agreement

By booking a session with K. Pauw Photography, the Client acknowledges and agrees to these Terms & Conditions. These terms may be updated at any time, and continued use of services constitutes acceptance of the latest version.
